ELIGIBILITY: To enter the Midnight Velvet Start of the Month Sweepstakes (the “Sweepstakes”), you must be a legal U.S. resident 21 years of age or older physically residing in the 50 United States (includes DC) to enter or win. Employees of Sponsor or its affiliates, sales representatives, agencies, dealers, retailers, wholesalers, distributors, and promotional and other vendor agencies involved in the promotion, and the immediate family (parent, spouse, sibling, child, grandparent) and household members of all such employees, are NOT eligible. Sweepstakes is subject to all federal, state, and local laws and regulations. Void where prohibited or restricted by law.

HOW TO ENTER: No purchase, entry fee, payment, or proof of purchase is necessary to participate.
To enter the Sweepstakes, visit MidnightVelvet.com/blog and click on the MV Star of the Month blog post.  Complete and submit the entry form found there, including uploading a photo. Entrants will also be asked to answer questions related to their home or fashion style. There is no correct answer. Submitted photos and answers will not be judged and will not have any effect or bearing on an entrant’s chance to win the sweepstakes. 

ENTRY PERIODS: The entry period for each monthly sweepstakes will begin at 12:00 a.m. Central Time (“CT”) on the first day of each month (i.e., September 1, October 1, November 1 , December 1, January 1, February 1, March 1, April 1, May 1, June 1, July 1), and will end at 11:59 p.m. CT on the last day of each month (i.e., September 31, October 31, November 30, December 31, January 31, February 29, March 31, April 30, May 31, June 30, July 31) respectively. Entries must be received or by 11:59 p.m. CT of the last day of a monthly entry period to be included in that month’s drawing. Entries not received within the stated entry periods will not be included. Note that July 2025 will be the last month for the sweepstakes.

Only one (1) entry per person/e-mail address/authorized e-mail account holder/physical address/telephone number per month. Any individual who attempts to enter, or submits entries in excess of the disclosed maximum, by any means, including but not limited to establishing multiple email accounts or using multiple addresses, will be disqualified from participation in this Sweepstakes. Sponsor is not responsible for lost, late, illegible, corrupted, or misdirected entries. 

Odds of winning depend on number of eligible entries received during each monthly entry period of the Sweepstakes. 

SELECTION OF THE MONTHLY STARS:
A new MV Star will be randomly selected from all entries each month. Drawings will be conducted in accordance with the Official Rules by Sponsor, whose decisions on all matters related to the Sweepstakes are binding and final. Winners will be notified by the 5th of the every month for the month prior by e-mail at the e-mail address provided on the entry form. Winner’s name will be published at midnightvelvet.com/blog by the 5th of every month. Prize will be mailed to the winner’s address provided in the entry form.

PRIZES AND APPROXIMATE RETAIL VALUES:

PRIZE AND APPROXIMATE RETAIL VALUES: One (1) winner will be randomly selected for each monthly sweepstakes to receive the following:

• $100 Midnight Velvet gift certificate (ARV: $100)

Taxes on prize are the sole responsibility of the winner. Any and all guarantees and warranties for merchandise prizes are subject to the manufacturers and/or service provider’s terms and conditions, and winners agree to look solely to such manufacturers and/or service providers for any warranty or guarantee claim. Prizes are non-transferable and no substitution or cash equivalent is allowed except in Sponsor’s sole discretion. Sponsor reserves the right to substitute prizes of the same approximate retail value. All costs and expenses not specified herein, related to any prize, including but not limited to delivery, installation, service activation fees and other expenses incurred by accepting the prize, are the sole responsibility of the Winner. Limit one (1) prize per person.  Prizes will be fulfilled one to four weeks after the drawing.

PHOTO ENTRY CRITERIA: Entrants can upload one (and only one) digital photo. Only digital photos will be accepted.  The photo must be of you (the entrant) and you ALONE. Subject to the conditions below, the photo can show you in whatever manner you deem appropriate to be designated as the MV Star of the Month. It is not required that you share what event you were attending, so staging a fictional glamorous night out is allowed. Professional studio shots, however, are not eligible. Full body photos are not required. All photographs should accurately reflect the subject matter and the scene as it appeared. Photos that have been digitally altered beyond standard optimization (removal of dust, reasonable adjustments to exposure, color and contrast, etc.) will be disqualified. Multiple exposures that have been combined to produce a single “High Dynamic Range” image will be disqualified. Disqualification of photos is at Sponsor’s sole discretion. 

Please Note: Photo must be entrant’s original creation and may not include copyrighted, trademarked, patented or previously published material. Entry requiring license or usage rights from any third party is not eligible. Entry may not display any trademarked or copyrighted brand names/logos, except those of Sponsor’s brands. If necessary, you may use your toolbar to blur out any brand names, logos, or trademarks.  Entry may depict entrant only; no other person may be depicted. Cropping out other individuals in the photo is required. Entry cannot defame or invade the rights or privacy of any person, living or deceased, or otherwise infringe upon any third party’s personal, proprietary, or intellectual rights. Entry cannot contain illegal or unlawful material, and must not promote bigotry, racism, harm, or discrimination. Entry must be consistent with Sponsor’s reputation in the marketplace and must be suitable for audiences of all ages. Entries which, in Sponsor’s sole discretion, contain any type of vulgarity or objectionable content will be disqualified. Entries that do not meet these stated criteria, or entries that (in Sponsor’s sole discretion) may technically meet the stated criteria but do not reflect the intent and the spirit of the contest, are not eligible.

By submitting entry, you agree to the following: (i) you are the owner of the photo, (ii) you are the one depicted in the photo, (iii) you are able and authorized to submit it, and (iv) you consent for us to post the photo online for public viewing.

PUBLICITY RELEASE: Except where prohibited, acceptance of a prize constitutes winner’s consent that his or her name, likeness, voice and/or biographical data may be used for advertising and promotional purposes without limitation and without additional notice, compensation, or consent. By filling out the fields, entrant agrees and authorizes Sponsor to post his or her submissions on Midnight Velvet’s website or Facebook page, without limitation and without additional notice, compensation, or consent. If Sponsor does post your submission, Sponsor will include only your first name and last initial along with your hometown if space and formatting permit. Otherwise, Sponsor will omit this information. 

RELEASE: By entering, entrant agrees to accept and abide by the rules of this Sweepstakes and agrees that any dispute with regard to the conduct of this Sweepstakes, rule interpretation, or award of prize shall be submitted to Sponsor, whose decision shall be binding and final. By participating, entrant agrees to release and hold harmless Sponsor, Facebook, participating dealers and retailers, affiliates, sales representatives, distributors and promotional and other vendor agencies, their respective parent companies, affiliates, subsidiaries, service agencies, independent contractors, and the officers, directors, employees, agents and representatives of any of the above organizations from any injury, loss or damage to person, including death, or property due in-whole or in-part, directly or indirectly, to the acceptance or use/misuse of a prize, participation in any Sweepstakes-related activity, or participation in the Sweepstakes.

Sponsor is not responsible for any typographical or other error in the printing of this offer, administration of the Sweepstakes, or in the announcement of prizes, including erroneous appearance of qualification for a prize, and under no circumstances will more than the stated number of prizes be awarded. Sponsor reserves the right, in its sole and absolute discretion, to modify, cancel, or suspend this Sweepstakes, or to amend the Official Rules at any time, without prior individual notice, should any factor interfere with the administration, security, or proper play of this Sweepstakes as contemplated by these Official Rules. If for any reason Sponsor is prevented from continuing with this Sweepstakes, or the integrity and/or feasibility of the Sweepstakes is severely undermined by any event including but not limited to fire, flood, epidemic, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, war (declared or undeclared), terrorist threat or activity, any federal, state, or local government law, order, or regulation, or any order of any court or jurisdiction, Sponsor shall have the right, in its sole discretion, to abbreviate, modify, suspend, cancel, or terminate the Sweepstakes without further obligation. If Sponsor in its discretion elects to so abbreviate the Sweepstakes, Sponsor reserves the right, but not the obligation, to award the prize from among all eligible entries received to date. All entries are the property of Sponsor and are not returnable.

This promotion is intended for viewing in the United States only and shall be construed and evaluated only according to United States law. Do not enter this Sweepstakes if you are not located in the United States. The use of any automated devices in connection with this Sweepstakes is prohibited. Sponsor assumes no responsibility for computer system, hardware, software, or program malfunctions or other errors, failures, delayed computer transactions, or network connections, whether human, technical, or otherwise in nature. Sponsor reserves the right, in its sole discretion, to cancel or suspend this Sweepstakes should virus, bugs, or other causes beyond its control corrupt the administration, security, or proper play of this Sweepstakes. Sponsor is not responsible for any injury or damage to any person’s computer or related equipment resulting from or relating to participation in this Sweepstakes or uploading/downloading any material related to this Sweepstakes. Entries will be deemed made by the authorized account holder of the e-mail address submitted at the time of entry. In the event of a dispute, the potential winner may be required to provide proof that he or she is the authorized holder of the identified e-mail account.

DISPUTES/CHOICE OF LAW: Except where prohibited, each entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by state or federal courts situated in Wisconsin, (2) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, but in no event attorneys’ fees, (3) no punitive, incidental, special, consequential, or other damages, including, without limitation, lost profits, may be awarded (collectively, “Special Damages”), and (4) entrant hereby waives all rights to claim Special Damages and all rights to such damages multiplied or increased. Wisconsin law, without reference to choice of law rules, governs the sweepstakes and all aspects related thereto.
